I Agree, I never thought it fair the whole Apple-DRI lawsuit seeing as GEM
was already being shown in late 83' and the fact that as you stated, the
Finder (actually going farther back, the Lisa Office) were right from
examination of the Xerox GUI, Win 1.0 was a total joke and Win 2.0 was still
a giggle and yes, its strange how Atari's TOS (CP/M68 & GEM) was left alone.
