I'm not entirely sure how useful some of this will be. From what I
gather, the lawsuit is less about notion of `windows', in the functional
sense, and more about a trademark infringement of the name Windows.
Admittedly, I think it's a insanely stupid that anyone is allowed to
trademark a common word. I also think it's insanely stupid that the
courts would consider Lindows and infringement on Windows. In a world
with more common sense, the courts would throw this stuff out
immediately.
Then again, common sense didn't prevent eBay's lawyers from coming after
me with threats of litigation, over trademark infringement, when I
registered the JoeBay.ORG domain name for my acquaintence, Joe Bay.
